Zoning Board of Appeals · Meeting of October 28, 2026
BARNSTABLE — The Barnstable Zoning Board of Appeals approved a special permit and 14 variances to split the 31-acre Southwind Plaza into six lots. Attorney John Kenney represented owner CR Southwind LLC, which bought the Hyannis plaza in January 2025 and surveyed it to find lot coverage at 64.2 percent against a permitted 62 percent and a 21-space parking shortfall out of 1,105 required. The board voted 5-0 on each item, including a variance letting the Home Depot lot reach 74.89 percent coverage.
Members Manny Alves and Paul Pinard pressed on whether subdividing the tract could let individual lots build up to the ordinance's 50 percent cap without review, eroding the plaza-wide limit; Kenney said recorded plan-conformance conditions would force any such change back before the board. No public comment was received on any of the 16 items. Kenney called it "a long, long haul" after working through all 16 appeals.
