Falmouth Board of Health Rejects Conditional IA Septic Requirement for Coastal Renovation, 2-3

FALMOUTH — June 22, 2026 — Falmouth Board of Health deadlocked 2-3 on requiring a nitrogen-reducing septic system as a condition of variance approval for a planned coastal renovation. The contested motion, brought by board member George at the June 22 meeting, would have required the owners of 227 Edgewater Drive West — a family property dating to 1959 in the EO Pond nitrogen-sensitive area — to install a denitrifying innovative alternative system capable of achieving below 10 milligrams per liter of total nitrogen before occupancy, as a condition of five Title 5 setback variances. The homeowner testified the combined cost of a standard system, an IA upgrade, and a future sewer connection could exceed $130,000, and engineer Chuck Roland of Cape and Islands Engineering argued the same variances would be required even without any addition to the house. West Falmouth Title 5 installer Maury Harlow-Hawkes told the board the motion amounted to holding applicants "hostage" through a variance process and urged the board to update its written regulations instead. The board's health agent said the case-by-case approach made consistent public guidance impossible. The board then voted 4-0 with one abstention to continue the application to its July 9 meeting pending Conservation Commission feedback; the board approved IA systems for two other septic applications — 11 Deshawn Drive and 51 Cliff Road — unanimously.
