Orleans Historical Commission Moves to Formalize List of 595 Historic Properties

ORLEANS — March 11, 2026 — Orleans Historical Commission debates formalizing a list of 595 historic properties subject to its demolition delay bylaw. Meeting March 11 with four of five members present, the commission devoted the majority of its session to Chapter 106, the town's demolition delay bylaw, which members said is too ambiguous to enforce reliably because the "historical property survey" it references has never been formally defined. Commission Chair Ed Painter proposed declaring that a 595-property inventory compiled by preservation consultant Eric Dre in 2023 constitutes the official survey — a move that would give homeowners and the building inspector a clear reference — but members noted roughly 150 of those properties still lack completed Form B records, a gap that could take two to three more years to close. A 1905 structure at 355 Tonset Road served as a live example of the bylaw's limits: because Dre excluded it from his survey, the commission concluded it has no legal basis to require a demolition delay hearing, even for a building more than 100 years old. Land-use attorney Ben Zender, appearing for the property's owners, agreed: "There's no basis in the current demo delay bylaw to impose a delay on this building." No formal votes were taken on the definition question; the commission agreed to prepare a memo, seek town counsel's opinion, and bring a proposed bylaw revision — including an 18-month delay period and a rolling 75-year age threshold — to its April 8 meeting.
