Zoning Board Approves Shed, Pool Variances

Yarmouth's Zoning Board of Appeals approved two setback variances and pushed two bigger cases to October. The board voted 5-0 to let Christopher and Angela Moniz build a shed at 3 Paula Lane with reduced setbacks, and 5-0 to let Robert P. Pingeton Jr. and Suzanne S.

Pingeton install a 22-by-28-foot above-ground pool at 146 Beacon Street despite a two-foot shortfall on a bike-path setback. Chairman Sean Igoe called the pool case "a good test case" for the state's newer "practical difficulty" variance standard, which replaced the old "substantial hardship" requirement. Separately, the board continued a three-duplex special permit sought by Steven M.

Katz for 703 Route 28 and a contested teardown-and-rebuild variance sought by Albert J. Muldoon III and Patricia J. Muldoon for 28 Little Dipper Lane, both to October 8, after the Muldoons' attorney, Paul Tardif, said the family hoped minor "tweaks" to the plans would ease abutter concerns.
