Orleans Architectural Review Committee asserts authority over building scale under new overlay district

ORLEANS — January 22, 2026 — Orleans Architectural Review Committee debates its authority over tall buildings and lighting enforcement. The committee, meeting January 22 with three voting members present after one member was absent due to illness, spent the bulk of its session on two questions raised by the town's newly adopted downtown overlay district, which allows building heights of up to 44 feet in its village-scale corridor sub-district and 54 feet in its commercial sub-district. Members said a pre-meeting memo from Building Commissioner Davis Walters confirmed the committee can condition or deny sign approvals when site lighting does not comply with the Orleans lighting bylaw — authority members said they had not previously exercised. The committee also confirmed that a May 8 approval of a sign for a business identified as "Fair," conditioned on lighting bylaw compliance, was never enforced. On the overlay district, newer member Andrew argued that the committee's design criteria — specifically criterion four, requiring proposals to show scale "compatible with other structures in the surrounding area" — give the committee authority to reject buildings that meet the overlay's height maximums but conflict with surrounding context, and that doing so carries no liability. The committee reported that Planning Board member George Maservi, author of the overlay district article, affirmed the committee's continuing review role in a prior meeting.
