The vote marked the board's first application of a Massachusetts variance law signed July 9, 2026, which replaced the longstanding "substantial hardship" test with a "practical difficulty" standard that balances applicant and public benefits against neighborhood detriment without requiring satisfaction of every criterion.

Member Anthony Panebianco read the new criteria into the record and concluded the petition met them, noting no health or safety impact on abutters, no feasible alternative to moving the hot tub, and no self-created hardship since Bomback purchased the property in 2025.
