Yarmouth Zoning Board unanimously applies new state variance standard for the first time, approving a South Yarmouth gazebo. The Yarmouth Zoning Board of Appeals voted 5-0 on July 23 to grant a rear-setback variance to Robert Bomback of 42 Four Seasons Drive, allowing construction of a 16-by-16-foot, 12-foot-tall gazebo over an existing hot tub that sits about 3 feet short of the required 20-foot rear setback under bylaw section 203.5. The vote marked the board's first application of a Massachusetts variance law signed July 9, 2026, which replaced the longstanding "substantial hardship" test with a "practical difficulty" standard that balances applicant and public benefits against neighborhood detriment without requiring satisfaction of every criterion.

Member Anthony Panebianco read the new criteria into the record and concluded the petition met them, noting no health or safety impact on abutters, no feasible alternative to moving the hot tub, and no self-created hardship since Bomback purchased the property in 2025. Vice Chair Dick Martin had flagged that the petition was filed June 29 — ten days before the new law's effective date — but Chair Sean Igoe steered the board to apply the newer standard.
