Boards Briefed on Sweeping New State Zoning Rules

Eastham's Planning Board, Zoning Board of Appeals and Zoning Bylaw Task Force learned their bylaw is already overridden by a rewritten state zoning law. Town Counsel Carolyn Murray, of KP Law, told the boards a July budget bill replaced the old variance "hardship" test with a "practical difficulty" standard, weighing benefit to applicants and housing production against neighborhood detriment. "That's a lot to digest, to be honest," Murray said.
Variances now last two years, up from one; the abandonment period for nonconforming uses doubled to four years; and some nonconforming structures can now expand by right without Zoning Board review. No amendments were voted; staff are eyeing the spring 2027 town meeting for bylaw cleanup articles, coordinating with the Select Board on how many to bring forward.
